1. Seller Information
These Terms & Conditions govern purchases made through Meme Material, available at https://memematerial.shop and its subdomains.
The seller is:

Hereinafter referred to as “Meme Material”, “we”, “us”, “the Store” or “the seller”.
The owner operates as a sole trader.
2. Scope
These Terms & Conditions apply to purchases of products made through Meme Material.
By placing an order, the customer confirms that they have been given the opportunity to review these Terms & Conditions and agree to be bound by them.
Before purchasing, customers will be provided with relevant information concerning the products, price, taxes, shipping charges, payment methods and applicable conditions.
3. Capacity to Contract
You must have sufficient legal capacity to enter into a contract in order to make a purchase.
If you act on behalf of another person or entity, you represent that you have sufficient authority to do so.
Meme Material may prevent or cancel transactions where there are reasonable indications of fraud, unauthorised payment methods, impersonation or other unlawful activity.
4. User Accounts
A Meme Material account with a verified email address is required to complete a purchase.
Users must provide accurate information and keep any information necessary for use of the service up to date.
Users are responsible for keeping their login credentials secure and preventing unauthorised access.
If you become aware of unauthorised use of your account, contact:
Email verification takes place when an account is created and whenever the email address associated with the account is changed.
An account with an already verified email address does not need to repeat verification before each purchase.
5. Products
Meme Material offers physical goods that may include clothing, mugs, posters, accessories, decorative items and other products.
Some or all products may be manufactured using Print-on-Demand systems and production may therefore begin after the customer places an order.
Product images and representations seek to accurately reflect their appearance. However, minor differences may result from factors such as screen settings, materials, printing processes, design positioning or normal manufacturing tolerances.
The main characteristics of each product will be stated on its product page.
6. Country Availability
Not every product is necessarily available in every territory.
Meme Material may determine product availability according to delivery country, provider capabilities, logistics restrictions and other relevant circumstances.
Availability initially displayed according to a selected or detected country remains subject to confirmation when the customer provides a valid delivery address.
The delivery address entered during checkout will determine final eligibility.
Meme Material will not allow completion of the purchase of a product that cannot be delivered to the stated destination.
7. Product Availability
All orders are subject to availability.
In exceptional circumstances, a product displayed as available may become unavailable before production can take place.
If an order cannot be fulfilled after payment has been taken, the customer will be informed and the corresponding amounts will be reimbursed without undue delay.
Meme Material will not unilaterally substitute another product unless the customer accepts the replacement or applicable law expressly permits it.
8. Prices
Each variant has the same price throughout Spain: the mainland, Balearic Islands, Canary Islands, Ceuta and Melilla. Delivery is included, with no additional shipping charge at checkout. The tax breakdown may depend on the destination without changing that price.
The total is displayed before payment authorisation. Potential import taxes and clearance charges not included are explained in the Shipping Policy and, where applicable, before payment. Price updates do not change accepted orders.
9. Pricing or Information Errors
Although Meme Material seeks to maintain accurate information, obvious pricing, description or availability errors may occasionally occur.
Where an error is identified before the contract is finally concluded, we will inform the customer and allow them to proceed under the corrected conditions or cancel the transaction.
Nothing in this section permits Meme Material to unilaterally modify an already concluded consumer contract to the customer's detriment.
10. Shopping Cart
Adding a product to the shopping cart does not reserve it or guarantee availability.
Cart contents may be retained for a limited period to allow users to continue shopping later.
Prices, availability, shipping charges and applicable taxes will be revalidated before payment.
11. Ordering Process
Customers must complete the steps presented by the Store.
These may include selecting products and quantities, reviewing the cart, signing in or creating an account, verifying an email address where required, providing delivery details, selecting shipping options, reviewing the total amount and completing payment.
Customers will have an opportunity to review the information entered and correct errors before submitting the order.
The final ordering mechanism will clearly indicate that submitting the order entails an obligation to pay.
12. Formation of the Contract
After you confirm the order and successfully authorise payment, we send an electronic confirmation that you can retain. Authorisation temporarily reserves the amount on your payment method; it is not yet a final charge.
The order is subject to the availability checks disclosed before ordering. If we cannot fulfil it, we will notify you and request release of the full hold. This condition does not restrict consumer rights or allow us to change the agreed price unilaterally.
13. Order Confirmation
The confirmation may include the order number, products, quantities, amount paid, delivery address, shipping method and other relevant information.
Customers may view their orders through their Meme Material account.
Customers should review the confirmation and notify us of any errors as soon as possible.
14. Payment
Meme Material uses specialist payment service providers.
Payments may initially be processed by Stripe using the payment methods available at the relevant time.
Meme Material does not directly store customers' complete payment card details.
Available payment methods will be displayed before purchase.
15. Payment Authorisation and Failure
Payment is authorised first and captured after approximately two hours, once availability and the information needed to process the order have been checked again. Bank authorisation does not reserve stock with the manufacturer.
If an item that was available becomes unavailable before capture, we cancel the order, request release of the hold and email you the reason. We also release it if we cannot complete the checks within our operational deadline. Your bank determines when the amount becomes available again.
If you expressly accepted a temporarily out-of-stock item, delivery may take more than two weeks. The displayed delivery estimate and your statutory rights still apply. Production is not requested before capture is confirmed.
16. Print-on-Demand Manufacturing
Print-on-Demand products may enter production shortly after payment is confirmed.
Production time is separate from shipping time and both may contribute to the total delivery period.
Being manufactured after an order is placed does not automatically make a standard catalogue item a legally personalised product.
Where goods are genuinely made to the customer's individual specifications or clearly personalised, this will be disclosed before purchase where it affects statutory consumer rights.
17. Shipping
Available destinations, shipping costs and estimated delivery times are described in more detail in our Shipping Policy.
A single customer order may result in multiple manufacturing processes and packages.
Products may be manufactured at different locations, shipped on different dates, handled by different carriers and have separate tracking numbers.
Applicable shipping charges will be shown before payment.
18. Delivery Address
Customers are responsible for providing a complete and accurate shipping address.
If an error is discovered, it should be reported as soon as possible.
Meme Material will attempt to update the address where manufacturing and shipping status permit, but cannot guarantee that an order already in production or transit can be changed.
Consequences and potential costs resulting from a failed delivery will be assessed according to the circumstances and applicable consumer rights.
19. Cancellation Before Production
You may request cancellation from your order during the period before capture, provided payment finalisation has not begun. We will request release of the hold; this does not require refunding a charge that has not been collected.
After capture we will try to stop production where the provider allows it and process any refund due. Inability to stop manufacturing does not remove statutory withdrawal or conformity rights.
20. Right of Withdrawal
Where Spanish consumer law applies, consumers generally have 14 calendar days following receipt of the goods to withdraw from a distance purchase without giving a reason.
Applicable rules concerning orders delivered in multiple shipments will determine when this period begins.

21. Personalised Products
Applicable consumer law provides certain exceptions to withdrawal rights, including goods made to the consumer's specifications or clearly personalised.
This may apply where a customer specifically requests the inclusion of their own name, photograph, text, image or design.
The fact that a standard Meme Material product is printed after purchase does not automatically make it personalised for this purpose.
Where a product is excluded from withdrawal rights for this reason, the customer will be informed before purchase.
22. Returns and Refunds
Complete return conditions are available in our Returns & Refunds Policy.
Where a consumer validly exercises a right of withdrawal, Meme Material will make the required reimbursement within the legally applicable period.
Refunds will generally be made using the original payment method unless another legally valid arrangement is agreed.
For sales of goods, Meme Material may withhold reimbursement until it receives the returned goods or sufficient evidence that they have been sent back where applicable law permits.
23. Return Costs
Where a consumer voluntarily exercises a right of withdrawal in relation to correctly supplied goods and has been properly informed in advance, the customer may be required to bear the direct return cost in accordance with applicable law.
Where goods are defective, incorrectly manufactured, incorrectly supplied or otherwise non-conforming for reasons for which the seller is responsible, the customer will not be charged costs that legally fall on Meme Material.
24. Defective or Non-Conforming Goods
Meme Material is responsible to consumers for lack of conformity in accordance with applicable law.
Where a product has a manufacturing defect, printing error, damage, characteristics different from those agreed or another lack of conformity, customers should contact Meme Material.
Depending on the circumstances and applicable law, consumers may be entitled to repair, replacement, price reduction or termination of the contract.
25. Evidence of Product Issues
Where a product is defective, incorrect or damaged, Meme Material may reasonably request photographs or other information required to identify the issue and process the claim.
Such requests will not restrict statutory consumer rights or impose disproportionate barriers to exercising those rights.
26. Print-on-Demand Providers
Although Meme Material may use third-party providers to manufacture or ship products, the customer's sales contract is with Meme Material.
Customers will not be required to pursue Printful, Printify, Gelato, carriers or other providers directly where Meme Material is legally responsible as the seller.
Meme Material will internally handle claims and cost recoveries involving its providers.
27. Promotions and Discount Codes
Meme Material may offer discounts, promotions or promotional codes.
Promotions may have specific conditions including validity dates, eligible products, territories, minimum purchase amounts or other restrictions.
Unless expressly stated otherwise, promotional codes have no cash value and may not be used after their expiry.
Promotional terms will never reduce mandatory consumer rights.
28. Intellectual and Industrial Property
Designs, text, images, logos, graphics and other content available through Meme Material are subject to applicable intellectual and industrial property rights.
Purchasing a product does not transfer intellectual property rights in the design appearing on it.
Products may be used personally in accordance with their ordinary purpose, but purchase does not grant permission to reproduce, manufacture, distribute or commercially exploit copies of the design.

29. Third-Party and Internet Culture References
Meme Material may create products inspired by cultural phenomena, public events, phrases, trends or Internet culture.
Third-party trademarks, works, logos, names and other protected rights remain the property of their respective owners.
Reference to a third party does not necessarily imply sponsorship, collaboration or endorsement.

30. Proper Use of the Platform
Users agree not to use Meme Material to engage in fraudulent transactions, use payment methods without authorisation, access other users' accounts, interfere with the website, exploit vulnerabilities, introduce malicious software, abuse returns or refunds or engage in other unlawful activity.
Meme Material may take reasonable measures to protect the Store and its users against fraud and abuse.
31. Account Suspension
Meme Material may temporarily suspend or restrict an account where there are reasonable indications of fraud, unauthorised access, serious platform abuse, unlawful use, risk to other users or material breach of these Terms.
Where circumstances permit, Meme Material will seek to inform the user and provide an opportunity to clarify the situation.
Account suspension does not remove existing obligations concerning previously placed orders or mandatory consumer rights.
32. Liability
Meme Material will be liable to users to the extent required by applicable law.
Nothing in these Terms excludes or limits consumer rights or liabilities that cannot legally be excluded or limited.
Any limitations in this section will always be interpreted consistently with mandatory consumer protection rules.
33. Circumstances Beyond Reasonable Control
Events may occur that temporarily delay or interfere with performance, including natural disasters, conflicts, major transportation disruption, widespread infrastructure failures and similar circumstances beyond the parties' reasonable control.
Meme Material will take reasonable steps to mitigate their impact and inform affected customers.
This section does not exclude any mandatory consumer rights.
34. Data Protection
Processing of personal data relating to accounts, orders, payments, support and other Meme Material functionality is governed by our Privacy Policy.
Creating an account or purchasing a product does not automatically subscribe the user to marketing communications.
35. Cookies
The use of cookies and similar technologies is explained in our Cookie Policy.
Optional technologies subject to consent will be managed according to the user's choices.
36. Communications
Order and account communications may be sent to the verified email address associated with the user's account.
Users are responsible for keeping that address up to date.
Transactional messages required to operate an account or fulfil an order do not constitute a voluntary marketing subscription.

Where the enquiry concerns an order, please provide the relevant order number where possible.
38. Dispute Resolution
Meme Material will seek to resolve customer complaints directly.
Consumers retain any rights to complaints procedures, mediation, alternative dispute resolution or court proceedings available under applicable law.
39. Applicable Law and Jurisdiction
Meme Material is established in Spain and these Terms & Conditions are governed by Spanish law.
However, where the purchaser is a consumer resident in another territory, this choice will not deprive that consumer of any mandatory protections applicable under the relevant law.
Any provisions concerning jurisdiction will be interpreted consistently with mandatory consumer jurisdiction rules.
40. Language
Meme Material may make these Terms & Conditions available in multiple languages.
For transactions with consumers in Spain, contractual information will be made available at least in Spanish as required by applicable rules.
Translations are intended to reflect the same meaning across versions.
Any conflict between versions will be resolved in accordance with the mandatory law applicable to the relevant contract.
41. Severability
If any provision of these Terms & Conditions is held to be invalid, unlawful or unenforceable, the remaining provisions will remain effective where they can operate independently.
42. Changes to These Terms
Meme Material may amend these Terms & Conditions where its services, providers, business processes or legal requirements change.
New terms will apply to purchases made after they take effect.
Orders previously placed will remain governed by the conditions applicable at the time of purchase unless a later change is legally mandatory or more favourable to the consumer.
The current version will always state the date on which it was last updated.
